TERMS AND CONDITIONS

  1. FORMATION OF THE CONTRACT
    1.1 You should read these terms carefully before you place an order from www.johandeckmann.com/prints. You will be asked to accept these terms before placing your order. If you do not agree to these terms, you should not place an order.

1.2 To place an order, you will need to add products to your cart on the relevant “store” page of the website, click on the “cart” to see your order, proceed to checkout, and provide us with the billing and shipping information requested. The order process allows you to check and amend any errors before submitting your order to us. Please take the time to read and check your order at each page of the order process.

1.3 Deckmann Studio reserves the rights to update and change the terms and conditions at any time. By visiting www.johandeckmann.com/prints you accept the terms and conditions as specified this page after any modifications to these terms. Please continue to review the terms and conditions after each visit to the site. You agree to indemnify, defend and hold Deckmann Studio harmless from and against all losses, claims, damages, expenses and costs, including attorneys’ fees resulting from any violation of these terms and conditions related to your account by you or any other person accessing the site using your account.

  1. ORDER PROCESSING
    2.1 Please allow 24-36 hours to process your order. We ship once a week.
  2. PRIVACY POLICY
    3.1 Personally-identifiable information (such as your name, address, e-mail address, or phone number) will not be collected unless given by you voluntarily and knowingly. In the case that you do submit personally-identifiable information to us, it may be stored by Deckmann Studio and may be used by Deckmann Studio to contact you. Your personally-identifiable information will not be sold, rented or disclosed to a third party for use in marketing or solicitation. Deckmann Studio will confidentially maintain your personal information and will use it only to enhance or support your relationship with us.
  3. AGE RESTRICTION
    4.1 If you are a consumer, you must be at least 18 years old to order products from the online store. By accepting these Terms, you are confirming that you are no less than 18 years old. If you are using the store to purchase products on behalf of a business, by accepting these Terms, you confirm that you have authority to bind such business to a contract with Deckmann Studio for the purchase of products.
  4. AVAILABILITY, DESCRIPTION, SPECIFICATION AND PRICE
    5.1 All products are subject to availability. If on receipt of your order the products you have ordered are not in stock, Deckmann Studio will inform you as soon as possible, and refund you for any sum that has been paid by you or debited from your credit card for the goods and their delivery to you.

5.2 The price of the products will be the price quoted at the date the order is received. All prices are quoted in US dollars and are exclusive of delivery charges, which will be added to the price of the order on confirmation of the shipping address and prior to you making payment.

5.3 The price of the products shown on www.johandeckmann.com/prints is inclusive of ASDVAT (where applicable) at the relevant rate chargeable in Denmark at the date of your order.

5.4 Please note, for purchases outside Denmark, your bank may charge an international processing fee.

  1. PAYMENT
    6.1 Payment for the products and delivery charges can be made by any debit or credit card that is shown as acceptable on the website at the time you place your order (presently being Visa/MasterCard/American Express/Discover/Dankort).

6.2 Payments with credit cards will be charged a fee of 0,7 % of the transaction value if the card is issued in Denmark and 1,95 % if the card is issued outside of Denmark. The fee will be itemised on your receipt. Debit cards will not be charged a fee. Please contact your card issuer, if you are not sure whether your card is a credit or a debit card.

  1. DELIVERY AND RISK
    7.1 The goods you order will be delivered to the shipping address you give when you place your order, subject to confirmation of acceptance of your order by Deckmann Studio.

7.2 All editions or other artwork ordered from Deckmann Studio shall be sent to you via a secure courier service.

7.3 If there is no one available at the delivery address to accept delivery of the goods, you will be asked to re-arrange delivery for an alternative date or to collect the goods from a specified place. Where the delivery address is within Denmark and you wish the goods to be redelivered to you, you shall be liable for the costs of re-delivery and the goods shall not be re-delivered until Deckmann Studio has received payment in full for such costs.

  1. RETURN POLICY 
    Purchases can be returned for a refund within 14 days of receipt of goods. You have the right to open the package to check your goods, but products must be returned unused. You will be refunded for the value of the product(s), including the outgoing shipping. Return shipping costs will not be refunded. All original packaging with must be intact. Returns which do not comply with these criteria risk being refused. Please note that you are responsible for the product until it reaches us, so send the package with a traceable service so it can be located. All returns along with order number should be sent to:

PRIVACY POLICY

As a data controller, Deckmann Studio is required to protect your personal data when you establish a contract with us as a private supplier or private client, or when you use the other services we provide. We endeavour to ensure that you feel comfortable with our treatment of your data. We process personal data in accordance with this Privacy Policy and current legislation.

  • When do we collect personal data and when do we use it?

We collect data in the following situations:

  1. When private suppliers establish contracts with us.
  2. When private clients establish contracts with us or otherwise use the services we provide.

When you, as a private supplier, deliver products to us, we collect a range of data in order to ensure that we can establish contact with you when someone expresses interest in purchasing a product, or when we need to get in touch for other reasons. We only collect essential data, such as your name, address, phone number, and email address. This data is safely stored in our client and product system.

When you, as a private client, express interest in purchasing a product, participating an event, receiving newsletters, or otherwise using the services we provide, we collect a range of data in order to ensure that we can monitor your relationship with Deckmann Studio, as well as to ensure that we can monitor your purchases. We only collect essential data, such as your name, address, phone number, email address, artistic interests and a history of your previous purchases and/or sales. This data is safely stored in our client and product system.

Personal data is only processed and stored when it has been willingly shared, such as in connection with a purchase, participation in an event, subscription to our newsletter, and when you contact us by phone or email.

Please note that in some cases, you are required to share personal data such as your name, address, phone number, and email address, as this data may be required for the sale or purchase of a product. We will not be able to establish an agreement regarding the purchase/sale of a product if you refuse to share this data with us.

 

  • For what purposes do we use personal data?

We use personal data for the following purposes:

  1. To efficiently handle the purchase/sale of products (e.g. in connection with invoices).
  2. To set up a profile for you in our client and product system.

iii.        To allow us to efficiently contact you (e.g. in connection with the purchase/sale of products).

  1. To efficiently respond to queries.
  2. To send you our newsletter if you have opted to receive this.
  3. To invite you to events and to efficiently plan said events.

vii.        To offer you the products and services you have requested.

viii.        For marketing purposes.

  1. To locate sold works in the event of a retrospective museum/ art institution exhibition and establish contact between buyer and museum / art institution with buyers permission.

 

  • On what grounds do we treat your personal data?

We process your personal data as outlined above on the following grounds:

  1. Your consent.
  2. The processing being necessary in order to honour an arrangement with you or to take steps requested by you prior to the establishment of such an agreement.

iii.        The processing being necessary in order to fulfil our legal responsibilities.

  1. The processing being necessary to ensure that the data controller or a third party can pursue legitimate interests, unless the registered party’s interests or basic rights and freedoms that require protection of personal data take precedence to this pursuit of interests, namely if the registered party is a child. The pursuit of legitimate interests is operated by the gallery.

 

  • Are we allowed to send you marketing material?

We would like to send you marketing material that we believe you might find interesting.

We will only send you marketing material if you give us permission to do so and if you have previously opted to receive marketing material from us, you are always free to opt back out.

  • When do we pass on your personal data?

We reserve the right to pass on your personal data under certain circumstances. Your personal data may be passed on to: (i) suppliers with whom we work in order to provide you with the services related to your association with Deckmann Studio (including service suppliers, such as marketing, services, and support teams; (ii) other third parties, in connection with the purchase/sale of products; or (iii) legal bodies if this is required by law.

Your data will only be passed on to the extent, and to the parties, required in order to supply the service requested, e.g. in connection with the creation of a client profile in the client and product system.

 

  • How long do we store your personal data?

Deckmann Studio stores your personal data for as long as it is necessary in order to provide the services requested, to serve a justified purpose (like monitoring you as a private supplier or client in our client and product system), or to meet the requirements of current legislation. We remove personal data on a continuous basis, deleting data that has served the purpose for which it was stored.

 

  • What are your rights?

You reserve the right to access the personal data of yours that we process. Should it turn out that this data is incorrect or misleading, you reserve the right to request that we amend, block, or delete this data. Furthermore, you are always free to protest further processing of your personal data, as well as to limit further processing of this.

If the processing of your personal data is based on your consent, you reserve the right to rescind this consent. This rescinding of your consent will not affect the legality of processing that occurred before your consent was rescinded.

If your personal data is being used for marketing purposes, you also reserve the right to protest further processing of your personal data for these purposes, including protest against profiling within the context of direct marketing.

We update this Privacy Policy on a regular basis to ensure that it continues to provide the most accurate information possible, as well as to ensure that it is in accordance with current legislation.
